Terms of Use

These terms and conditions apply to the Simmer app for iPhone and Apple Watch, together with any related services operated by Rauf Salikhov (collectively, the "Application"). Rauf Salikhov is hereby referred to as the "Service Provider". These terms also cover simmer.avrdu.de and the Simmer API.

By downloading or using the Application, you agree to these Terms and Conditions. You should read them carefully before using the Application.

Application licence

The App Store application is licensed under Apple's Standard Licensed Application End User License Agreement, unless a custom EULA is supplied in App Store Connect. These terms govern the associated service and supplement that licence. Apple’s applicable terms govern App Store purchases.

Accounts and acceptable use

You must be legally able to accept these terms or have the permission required by applicable law. You are responsible for keeping your sign-in account and device secure. You must not use Simmer unlawfully, infringe others’ rights, distribute malware, attempt unauthorized access or disrupt the service.

Intellectual property

The Service Provider retains all intellectual property rights in the Application, including its code, design, trademarks, service marks, trade names, logos, and branding (the "IP"). Nothing in these Terms grants you any license or right to use the Service Provider's trademarks, logos, or branding for any purpose. You agree not to remove, alter, or obscure any copyright, trademark, or other proprietary notices displayed in or on the Application.

User content

You retain ownership of your recipes and images. You grant us a non-exclusive licence to store, reproduce and display them as needed to provide the features you use. Publishing a recipe makes its text and image available to other users and public visitors.

Submit only content you own or have permission to use. Do not publish unlawful, abusive, misleading, confidential or infringing content, or other people's personal information without permission. Importing content does not transfer its author's rights to you.

Report illegal content or copyright infringement through the content reporting page. We may remove content or restrict accounts for violations, security reasons or legal requirements. Contact us to request review of a decision.

Subscriptions and payments

Premium is available through monthly or annual auto-renewable subscriptions. Features, prices and billing periods are shown before purchase. Apple charges your Apple Account. Subscriptions renew automatically unless cancelled at least 24 hours before the current period ends; renewal charges may occur during those final 24 hours. Trial and introductory offers apply only when shown at purchase, and any unused free trial may be forfeited when you subscribe.

Manage or cancel subscriptions in Apple Settings. Cancellation generally takes effect at the end of the paid period. Restore Purchases is available in Simmer's Profile. Apple handles refund requests, subject to applicable law. Deleting the app or your Simmer account does not cancel billing. See subscriptions and refunds.

Third-party services

Sign-in, payments and external recipe sources are subject to their providers' applicable terms. Some features require an internet connection, compatible device, account or subscription. You are responsible for any network charges.

Recipe information

Recipes, cooking times, unit conversions and nutrition estimates are general information. Check allergens, ingredient labels, dietary suitability, cooking temperatures and safe food handling. Simmer does not provide medical advice.

Account deletion and termination

You can delete your account from Profile → Delete Account or contact support. Local libraries remain on your devices. Retention of images, logs and backups is described in the Privacy Policy. We may suspend or terminate access for material violations, security risks or legal obligations, with notice where appropriate.

Availability and liability

The service is provided as available. We do not guarantee uninterrupted availability or the accuracy of third-party content. We may update or discontinue features, with notice where appropriate and subject to applicable consumer law.

To the extent permitted by law, we are not liable for indirect or consequential losses arising from use of the service. Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud or personal injury caused by negligence, or limits mandatory consumer rights.

Governing law

Serbian law applies, subject to mandatory consumer protections. Disputes may be brought before courts that have jurisdiction under applicable law, including any right to bring a claim in your place of residence.

Severability

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.

Changes to these terms

We update the date on this page when these terms change and provide notice of material changes where required. Changes do not remove rights you already have.
